Who we are
Smarter Coaching, LLC operates The Performance Code and is responsible for your data. You can reach us at jasoneisnerconsulting@gmail.com.
The product runs on a platform built and maintained by Jason Eisner Consulting, under contract to us. They process your data to keep the service running, on our instructions and for no purpose of their own.
The coaching method is Michael R. Allison's.
What we collect
What you tell us. Your email address, and everything you write to the coach. Your answers to the check-in questions.
What we work out from what you write. Which zone your own words point to, which resources you reach for, and how that moves over time. This is the product.
What we never collect, and this one is a commitment rather than a default. We do not listen to your voice. We do not analyse your tone, your speech, your typing speed, your heart rate or any signal from a device. The coach reads what you type and what you tell it, and nothing else. If that ever changes we will say so before it does, not after.
If you tap the microphone. Speaking instead of typing uses your browser's own speech-to-text, not ours. Your browser turns what you say into text and hands us only the text: we never receive or keep any audio. To do that, your browser may send the audio to its maker under its own terms (Chrome sends it to Google, Safari to Apple). If you would rather it did not, type instead; nothing in the app needs your voice.
Technical data. Sign-in times, and error reports when something breaks.
Why we hold it
To be a coach that remembers you. A coach that forgot you between sessions would be a search box, and most of what makes this useful is continuity.
We do not sell your data. We do not advertise to you. We do not train models on your conversations.
Who else touches it
Running this product means other companies process parts of your data.
| Who | What they do | What they see |
|---|---|---|
| Supabase | Database and sign-in | Everything |
| Anthropic | The coaching model | Your conversation |
| Voyage AI | Makes content searchable | Content text, and your saved notes when indexed |
| Sentry | Tells us when something breaks | Error reports |
| Inngest | Runs background work | References to your account |
| Resend | Sends your sign-in email | Your email address |
| Sign-in, only if you choose "Continue with Google" | Your Google account's email and name |
Your data is stored in the United States. [cross border transfer note to be confirmed]
What you can do
Both of these are built and work today. They are not promises.
Get everything. Settings gives you a download of every piece of data we hold about you, as one file.
Delete everything. Settings deletes your account. That removes your conversations, your memory, your readings and your sign-in, and it cascades across every table keyed to you. It is not a flag or a queue; the rows go.
Depending on where you live you may also have rights to correct data, to object to processing, or to complain to a regulator. [regional rights note to be confirmed]
How long we keep it
We keep your data until you delete it. We are telling you that plainly rather than quoting a retention window, because this product does not implement one. If we build automatic deletion we will say so here and describe what it actually does.
This is not therapy
The Performance Code is a coaching product. It is not therapy, not medical care, and not a crisis service. The coach is not a clinician and does not diagnose or treat anything.
If you are in crisis, please contact a local emergency service or crisis line. The coach will say the same thing and will point you there.
About the method
The method draws on polyvagal theory, which is actively debated among researchers. It is widely used in clinical practice and its author is a practitioner within it. We describe it the way the book does: as a useful account of lived experience anchored to the biology, rather than as settled neuroscience. We would rather tell you that than let a product imply more certainty than the field has.
You are talking to an AI
The coach is an AI. It says so, and it will confirm it if you ask. It is not Michael Allison and it is not a person.
Changes
If we change this policy we will say what changed and when. The version is at the bottom of every published copy.
